Since August 1, 2024, the EU AI Act has been in force for the use of Artificial Intelligence (AI).

What exactly does the EU AI Act include?

Who is affected?

The EU AI Act applies to all who develop, distribute, or use AI systems in the EU. Providers and operators from third countries are also affected if their systems are deployed in the EU.

Affected parties

  • Providers, importers, distributors, and operators of AI systems (in the EU)

  • Providers and operators of AI systems from third countries, if the result produced by the system is used within the EU

Actors not affected

  • AI systems for exclusively military purposes, law enforcement, R&D activities, and open-source software

What are the potential consequences?

Companies that violate the EU AI Act face significant penalties. Depending on the severity of the violation, they may be subject to heavy fines and even the removal of non-compliant AI systems from the market.

Fines

  • Prohibited AI systems: Penalties of up to EUR 35 million or 7% of global annual turnover
  • Minor violations: penalties of up to EUR 15 million or 3% of global annual turnover
  • False information: penalties of up to EUR 7.5 million or 1.5% of global annual turnover

What are the deadlines?

The EU AI Act will come into force gradually, with clear deadlines for various obligations. Companies must act on time to comply with bans, transparency obligations, and compliance requirements by the deadlines.

  • Ban of AI systems with unacceptable risks

  • Requirement for AI competence

  • Requirements for general-purpose AI models

  • Requirements for high-risk AI systems

  • Transparency obligations

  • Fines for providers of general-purpose AI models

  • Requirements for high-risk AI systems that are already covered by EU law

  • Requirements for general-purpose AI models that were placed on the market or put into service before August 2, 2025

  • All other provisions of the AI Act become binding
